Terms of Service

1. Acceptance of Terms

By accessing or using Band Me Up (the "Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, you may not use the Service.

These Terms apply to all users of the Service, including bands, fans, and visitors.

2. Description of Service

Band Me Up is a web platform that allows bands and musicians to create and manage professional websites for showcasing their music, events, photos, videos, and other content. The Service includes:

  • Band profile creation and management
  • Content hosting (music, images, videos, events)
  • Custom domain support
  • Third-party integrations (Patreon, Bandsintown, Mailchimp)
  • Contact forms and messaging
  • Analytics and insights
  • Electronic Press Kit (EPK) generation
  • Venue and address autocomplete when editing band gigs and profile information (powered by Mapbox)
  • A free band availability tool that lets band members share when they are free, so the band can see overlapping availability at a glance

3. User Accounts

To use certain features of the Service, you must create an account. You agree to:

  • Provide accurate and complete information during registration
  • Maintain the security of your account credentials
  • Notify us immediately of any unauthorised use of your account
  • Be responsible for all activities under your account
  • Be at least 18 years of age to create an account

We reserve the right to suspend or terminate accounts that violate these Terms or are inactive for extended periods.

4. Subscription and Payment

4.0 Free Tier

Some features may be made available without payment, including the free band availability tool and bands created via event invite links. Access to free features is provided as-is and may be limited, modified, or withdrawn at any time without notice. Free-tier users remain bound by these Terms.

4.1 Free Trial

New band accounts receive a 14-day free trial. During the trial period:

  • You can build and preview your band website
  • You will not be charged
  • You may cancel at any time with no charge
  • Payment details are required to start the trial

4.2 Billing

After your free trial ends, you will be automatically charged the monthly subscription fee unless you cancel before the trial ends.

  • Subscriptions are billed monthly in advance
  • Billing is processed securely via Stripe
  • Prices are displayed in your local currency where supported (GBP, USD, EUR, AUD)
  • You authorise us to charge your payment method on file

4.3 Cancellation and Refunds

You may cancel your subscription at any time through your account settings or the Stripe Customer Portal. Upon cancellation:

  • Your band website will remain active until the end of your current billing period
  • You will not be charged again after the current period ends
  • Your band will become private (not visible to the public) after the subscription expires

Refund Policy: Due to the 14-day free trial, we do not offer refunds for subscription fees. If you experience issues with the Service, please contact us at support@bandmeup.com and we will work to resolve them.

4.4 Failed Payments

If a payment fails:

  • We will attempt to charge your payment method up to 8 times over a 2-week grace period
  • You will receive notification of the failed payment
  • Your band will remain active during the grace period
  • If payment cannot be processed within the grace period, your subscription will be cancelled and your band made private

4.5 Price Changes

We may change our pricing at any time. If we increase the price of your subscription, we will notify you at least 30 days in advance. The new price will apply from your next billing cycle.

5. Content Ownership and License

5.1 Your Content

You retain all ownership rights to content you upload to the Service, including music, images, videos, text, and other materials ("Your Content").

By uploading Your Content, you grant Band Me Up a worldwide, non-exclusive, royalty-free licence to:

  • Store, display, stream, and deliver Your Content via the Service
  • Make Your Content available to visitors of your band website
  • Create backups and technical copies necessary to operate the Service

This licence ends when you delete Your Content or terminate your account, except for backups which may remain for a reasonable period for disaster recovery purposes.

5.2 Our Content

The Service itself, including all software, design, text, graphics, and other materials (excluding Your Content), is owned by Band Me Up and protected by copyright, trademark, and other intellectual property laws.

6. Content Responsibilities

When uploading content to Band Me Up, you represent and warrant that:

  • You own all rights to the content or have obtained all necessary permissions
  • Your content does not infringe any copyright, trademark, or other intellectual property rights
  • Your content does not violate any laws or regulations
  • Your content does not contain malware, viruses, or malicious code

You are solely responsible for all content you upload. We do not pre-screen content, but reserve the right to remove any content that violates these Terms or is reported as infringing.

7. Acceptable Use Policy

You agree not to use the Service to:

  • Violate any laws or regulations
  • Infringe intellectual property rights
  • Upload or distribute malware, viruses, or harmful code
  • Harass, abuse, or harm others
  • Distribute spam or unsolicited messages
  • Impersonate others or misrepresent your affiliation
  • Interfere with or disrupt the Service or servers
  • Attempt to gain unauthorised access to any part of the Service
  • Scrape, crawl, or use automated tools to access the Service without permission
  • Use the Service for any illegal or unauthorised purpose

Violation of this policy may result in immediate termination of your account.

8. Custom Domains

Band Me Up allows you to connect custom domains to your band website. You are responsible for:

  • Purchasing and maintaining your domain name through a domain registrar
  • Configuring DNS settings correctly
  • Ensuring your domain complies with all applicable laws and does not infringe third-party rights
  • Renewing your domain before it expires

We are not responsible for domain registration, renewal, or disputes. If your domain expires or is removed, your band website will remain accessible via your Band Me Up subdomain (bandmeup.com/band/[your-username]).

9. Third-Party Integrations

Band Me Up integrates with third-party services including Patreon, Bandsintown, and Mailchimp. When you enable these integrations:

  • You grant Band Me Up permission to access your accounts on those services
  • You agree to the third party's terms of service and privacy policies
  • You are responsible for maintaining your accounts with those services
  • We are not responsible for the availability, functionality, or actions of third-party services

You may disconnect integrations at any time through your account settings.

10. Account Termination

10.1 Termination by You

You may delete your band at any time from the Settings page in your band admin. Upon deletion:

  • Your band website will be hidden from public view immediately
  • Your subscription will be cancelled at the end of the current billing period
  • You will have 30 days after your subscription ends to reactivate your band
  • After the 30-day grace period, all content and data will be permanently deleted
  • You may request a copy of your data before deletion by contacting support@bandmeup.com

10.2 Termination by Us

We reserve the right to suspend or terminate your account if:

  • You violate these Terms
  • Your payment fails and cannot be resolved
  • Your content infringes intellectual property rights
  • Your account is used for illegal activities
  • We are required to do so by law

We will provide notice where reasonably possible, but may terminate immediately in cases of serious violations.

11. Data and Privacy

Your use of the Service is governed by our Privacy Policy , which explains how we collect, use, and protect your personal information.

Under UK GDPR and the Data Protection Act 2018, you have the right to:

  • Access your personal data
  • Request correction of inaccurate data
  • Request deletion of your data (subject to legal obligations)
  • Export your data in a portable format
  • Lodge a complaint with the Information Commissioner's Office (ICO)

12. Limitation of Liability

To the fullest extent permitted by law:

  • The Service is provided "as is" without warranties of any kind
  • We do not guarantee the Service will be uninterrupted, secure, or error-free
  • We are not liable for any loss of data, revenue, or profits
  • Our total liability to you shall not exceed the amount you paid us in the 12 months prior to the claim
  • We are not liable for third-party services, content, or actions

Nothing in these Terms limits or excludes any liability that cannot be limited or excluded under applicable law, including liability for death or personal injury caused by negligence, fraud, or any statutory rights you have as a consumer.

13. Indemnification

You agree to indemnify and hold harmless Band Me Up, its officers, employees, and agents from any claims, damages, or expenses (including legal fees) arising from:

  • Your use of the Service
  • Your violation of these Terms
  • Your violation of any rights of another party
  • Your Content uploaded to the Service

14. Copyright Infringement Notices

We respect intellectual property rights. If you believe content on Band Me Up infringes your copyright under the Copyright, Designs and Patents Act 1988, please notify us at hello@bandmeup.com with:

  • Identification of the copyrighted work
  • Location of the infringing content (URL)
  • Your contact information
  • A statement that you have a good faith belief the use is unauthorised
  • A statement that the information is accurate and you are authorised to act on behalf of the copyright owner

We will investigate and remove infringing content where appropriate.

15. Changes to Terms

We may update these Terms from time to time. We will notify you of significant changes by:

  • Posting the updated Terms on this page
  • Updating the "Last Updated" date
  • Sending an email notification for material changes

Your continued use of the Service after changes are posted constitutes acceptance of the new Terms. If you do not agree to the changes, you must stop using the Service and cancel your account.

16. Governing Law and Disputes

These Terms are governed by the laws of England and Wales. Any disputes arising from these Terms or your use of the Service shall be resolved in the courts of England and Wales.

Nothing in this clause prevents consumers resident in the EU from bringing claims in their local courts where required by mandatory consumer law.

Before initiating legal action, you agree to attempt to resolve disputes through good faith negotiation by contacting hello@bandmeup.com.

17. Miscellaneous

Entire Agreement: These Terms, together with our Privacy Policy, constitute the entire agreement between you and Band Me Up.

Severability: If any provision of these Terms is found to be unenforceable, the remaining provisions will remain in full effect.

Waiver: Our failure to enforce any right or provision of these Terms will not be considered a waiver of those rights.

Assignment: You may not assign or transfer these Terms without our consent. We may assign these Terms without restriction.
